Understanding Workers’ Compensation Fraud

Posted on: April 13, 2016 by Javier iSure

The majority of Florida Workers Compensation claims are in fact legitimate and deserve immediate attention by the employer. However, there are plenty of fraudulent claims filed each year, costing the business thousands of dollars and lost productivity. Therefore, it’s important to understand the red flags of such cases in order to protect your business at all times. Let us now take a closer look at the most common types of fraudulent claims and how they come about.

These claims are traditionally submitted by employees who see an opportunity to earn more money and take it. While these claims were submitted by an employee who was actually injured on the job, they attempt to collect more benefits than they are owed. For example, they seek more compensation, draw out the claim for long periods of time, exaggerate their symptoms, stall appointments, and are uncooperative with treatment plans, as mentioned by Property Casualty 360.

These employees seek to take advantage of the company by submitting a benefit claim when they were not injured on the job. Instead, they suffered an injury elsewhere and are attempting to have your company pay for it.

These claims occur when an employee was injured on the job and has a legitimate claim but they are forgotten by their employer. While they may not have malicious intentions, a form of retaliation may take place, drawing out the claim process. This could occur if their job was replaced or if they are suffering from depression as a result of their injury.
